EEO: Frequently Asked Questions

Question: What services does the EEO office offer employees and managers
 in DENR?

Answer: This office is here to serve you--DENR employees and prospective
employees--on all services and decisions involving personnel and managerial actions. As such, some activities will be investigatory in nature.This office will not replace units or persons currently performing personnel or managerial functions and decisions, but will ensure such activities are administered fairly and in a nondiscriminatory manner. You are encouraged to work cooperatively with your manager or supervisor on issues of concern before seeking outside assistance.  This office will refer you to relevant units or agencies based on your needs and concerns. Confidentiality is of utmost importance in meeting your needs.

Question: What is the process for making a reasonable accommodation for
a disability?

Answer: According to the Equal Employment Opportunity Commission (EEOC), an employer should make a reasonable effort to determine the appropriate accommodation for a qualified disabled individual. The EEOC has devised a four-step process to use when an employee has requested an  accommodation for any aspect of employment.

Step One: Analyze the job to determine its essential functions. 

Step Two: Determine with employee how the disability limits their ability to
perform the essential function(s) of the job. 

Step Three: Identify accommodations to overcome limitations; determine
effectiveness and feasibility.

Step Four: Consider employee's preference and employer selects accommodation(s) appropriate for employee and employer.
Question: What do I do if I feel I am being sexually harassed?
Answer:   You are asked to follow the grievance procedure which includes:

Step One: Report the alleged misconduct to your immediate supervisor.

Step Two: If the immediate supervisor is involved, or you are not satisfied
with the results of step one, report the misconduct to the personnel officer.

Step Three: If you are not satisfied with the results in step two, appeal to
the DENR Secretary. The Secretary will either appoint a hearing officer to
hear the case or appoint a team to do a thorough investigation. All cases
alleging sexual harassment filed with the department will be promptly and
impartially processed. All facts and issues surrounding the misconduct will
be duly evaluated.

Step Four: Employees who feel the matter cannot be resolved through the
first two steps may begin with Step Three. Report the alleged misconduct to
the EEO office.
